    Community Rules

    Parking

    Owners are to park their vehicles in the garages were possible, ensuring they do not park in the areas that are marked with yellow lines. In particular, the bend in front of 3B is to be free of vehicles at all times to allow emergency services to safely navigate the turn.

    In regard to vacated vehicles parked on the street, the police advice is that they cannot do anything as we live in a gated community. Therefore, all Owners are encouraged to be alert and advise the President of any knowledge of ownership of the subject vehicles.

    Storing items in Community Areas

    A Community area is defined as any area beyond a front door and within the confines of the main fenced area. Those ground floor apartments that include gardens are the responsibility of the owners. Owners cannot use their car parks to temporarily or permanently store or dump personal items or rubbish. These spaces are for vehicles only.

    Owners cannot use any part of our community to temporarily or permanently store or dump personal items or rubbish.

    These items or rubbish will be removed one week after one warning. If and when the culprit is identified, they will incur the cost of removal.

    Dogs

    All owners are to ensure the following is to be adhered to at all times:

    1. Dogs are not be left alone in apartments, balconies and terraces unless they are trained not to bark,
    2. Owners of dogs should not allow dogs to bark on a continuous and annoying basis.
    3. Dogs are not allowed to roam the community without an owner and then, they are to be attached to a lead.
    4. Owners are to ensure their dogs do not defecate anywhere in the community or on terraces and balconies.

    Cats

    Stray cats are not to be fed in this area or any area on the development

    Barbeques

    All owners are to ensure they use their barbeques, respecting the comfort of all their neighbours. Do not use lighting fluids or blocks as they cause nasty smells and unnecessary smoke.

    The recommended type of briquette is contained in a yellow and red 1.6 kilo´s bag and is called "Magic Carbon". Simply place the bag on the barbeque and ignite the paper that contains the briquettes. They can be easily purchased for approximately 3 Euros.

    Children playing in the Community

    Parents are urged to ensure their children do not play in the streets unless they are supervised. If, for any reason parents are not willing to supervise their children, they are to ensure they play in a quiet and pleasant manner that does not affect the peace of all owners/tenants.

    Noise

    No loud and/or annoying noises are to be made anywhere in the community between the hours of 11.00pm and 08.00 am.

    As marble floors and thin walls cause more noise than normal, use slippers with soft bottoms instead of hard shoes, your bare feet or socks. Most importantly, use pads under the feet of chairs and tables on both internal and external furniture.

    Do not disturb your neighbours with loud music, television, parties, banging of doors and speaking loudly in corridors.

    Owners are encouraged to abide by these rules at all times of the day and night.

    Garbage

    All rubbish must be put in closed plastic bags and placed inside the rubbish bins which are located outside the front gate.

    Television Dishes

    Any television dish that is placed on the facade of a building and/or can be seen from the road/ground is strictly forbidden. If a dish needs to be installed, they are to be placed on the inside of balconies and terraces.

    Sky and Spanish television can be obtained without the use of private dishes and at a substantially reduced cost. For any further information contact the President.

    Clothes Lines

    Temporary clothes lines that have been randomly attached on balconies and terraces are not permitted as they are unsightly and do not reflect well on the community. There are many neat solutions to this issue and can be purchased at very reasonable prices.

    In addition, the balcony fencing is not to be used for hanging clothing, towels or mats ECT.

    Shaking items over balconies and terraces

    Owners are not shake mats, duvets or clothing from their balcony or terrace.

    Mosquito Gauze on Windows and Doors

    If an owner needs to install mosquito gauze on their windows and doors it has to be installed in a professional manner with standard light grey frames and translucent/light grey gauze. No green gauze is to be installed; especially in an ad hoc and unsightly manner.

    Steel Grates for Windows and Doors

    The security grates for the windows and doors are to be painted in green high gloss paint and constructed in the same style and colour as the green steel fencing on the development. The colour is Verdi Mayo by Uerotex. The grates are to be maintained and cleaned at all times.

    Steel doors are only to be installed directly in front of apartment entry doors.

    Front Doors and Security Blinds.

    The front door and security blinds to apartments are to be coloured in white and kept clean at all times.

    Enclosing Balconies and Towers leading to Penthouse Terraces.

    If an owner wishes to enclose their balcony they are to use Window Curtains with White Frames. A good example of this is 1A,1,1. Window coverings are strictly forbidden, i.e. curtains, blinds ECT.

    If an owner wishes to enclose their balcony and tower leading to their penthouse terrace:

    1. The arch window is to be installed in such a manner that no frame can be seen from the road unless opened and the frame is to be green, and
    2. The door leading to the terrace is to be constructed in a similar style and colour to the green steel grated door originally installed. A good example of the is 3A,2,4.

    Fencing on Balconies and Terraces

    Balcony fencing is to be of a green mesh type and neatly attached.

    Terrace fencing is to consist of green wires connected to green posts, covered with green mesh no higher than 180cm from the terrace floor and professionally attached. A good example of this is 3B,2,4. If a better and more expensive finish is preferred, green stained wood frames and wood angled cross sections are to be used. A good example of this is 1A,2,5.

    Covers for Penthouse Pergolas and Balcony Sun protectors

    Penthouse pergola covers are to be in either:

    1. Beige and terracotta stripes. An example of this is 3B,2,1 or
    2. Beige or green mesh neatly attached.

    Protruding balcony sun protectors are to be beige and terracotta stripes similar to the material in 3B, 2, 1.

    Gardens

    Under no circumstances is anyone to enter the gardened areas other than by the provided pathways. It is forbidden to take flowers or seedlings from the garden and NO bikes are to be used on any grassed or gardened area within the community.

    Fine system

    The following is the procedure relating to fining those owners who do not conform to Community rules and Spanish law.

    1. Firstly, if there are any complaints relating to the rules, owners should try and rectify the problems themselves. Secondly, if owners are unsuccessful, report the issue to the President or the Administrator and they will endeavour to rectify the problem. If they have no success, paragraphs b — f inclusive are to be ensued.
    2. Mail a letter/email to the owner and/or the tenant advising them that they are breaching a community rule and they have three (3) months to rectify the problem,
    3. If the problem has not been rectified, mail a second letter/email to the owner and/or the tenant advising them that they continue to breach a community rule and they have an additional month (1) to rectify the problem,
    4. If the problem has still not been rectified, mail a final letter/email to the owner and/or the tenant advising them that they continue to breach a community rule and they have an additional two (2) weeks to rectify the problem,
    5. If the problem has still not been rectified, the owner’s breach of the community rules will be tabled before the next meeting and a decision on a fine will be made.
    6. When an owner does not comply with an imposed fine and/or does not rectify the issue for which they have been fined within a period of one month, legal action will be taken.

    Permanent Building Structures.

    No permanent building works is to be carried out on the outside of an apartment, within a terrace or balcony and within a garden unless permission is given by a general assembly of owners. Contact the President for further advice.

    Pool and Sauna areas

    Pool

    The swimming pool and sauna is opened between the hours of 0900 – 2100 (the gates are to be locked at 2100 and strictly no use thereafter).

    The Pool Attendant’s schedule of work is from the 15th June to 15th September and between the hours of 1100 -1900. The pool attendant is responsible for safety and to ensure the rules are adhered to at all times. Please respect his/her position.

    The use of the pools and the area surrounding the pools is not permitted by children under the age of 14 without an adult.

    All persons are to shower before entering the pool.

    All rules clearly displayed around the pools are to be adhered to at all times, and are issued by the Spanish Government and a general assembly of owners. Therefore, the following are strictly forbidden in and/or around the pools

    1. The use of floating beds, balls and all other blow items with the exception of swimming aids,
    2. Glass bottles and containers,
    3. Behaviour that disturbs all pool users and residents,
    4. All rubbish not placed in the bins provided, i.e. cigarettes, plastics ect, and
    5. Running and screaming around the pool, and screaming in the pool.
    6. The use of skate boards, bikes, roller skates, ect, around the pool areas.
    7. Rough or dangerous games in or around the pool.
    8. The use of the pool while it is being cleaned.
    9. The use the pool if you have any infection.
    10. Night swimming.

    Sauna

    The sauna is only to be used by adults (18 years and over). However, children can use these facilities when accompanied by an adult.

    To reserve the sauna during the summer months you must contact the Pool Attendant to make a booking the day before use. During the winter months this is not a requirement.

    A shower is to be taken before using the sauna and if you wish to use the pool another shower is to be taken.

    The area is to be left clean at all times.

    Note: For the purpose of this Appendix, when referring to the "Owner", the owner is responsible for their tenants.
